Q: In the rare circumstance that the President is unavailable to run a meeting, is the Conference lay-spiritual advisor permitted to run the meeting?
A: The bylaws read that, if the President is unable to attend or preside at any meeting of the Conference, this privilege and duty may be delegated to the Vice President or any Officer. The spiritual advisor provides the necessary guidance to the Conference and its members on spiritual matters. Although appointed by the President, the spiritual advisor is not an officer and therefore should not be permitted to run a meeting.

Q: Are we prohibited from offering scholarships when the funds are there?
A: It all depends on the recipient of the intended scholarship. Scholarships to an elementary or high school would be improper because education is free in all communities. If the scholarship is for a needy college or trade school student, that would be considered a possibility and a valid undertaking because these are usually not offered at no charge.

P: En la circunstancia de que el Presidente no esté disponible para dirigir una reunión, ¿se le permite al Consejero Espiritual laico de la Conferencia dirigir la reunión?
R: Los Estatutos dicen que, si el Presidente no puede asistir o presidir cualquier reunión de la Conferencia, este privilegio y deber puede ser delegado al Vicepresidente o a cualquier Funcionario. Q: One of my new District Council Presidents is asking for a meeting template. Is there such a thing? I know the Rule has the Conference Agenda.
A: The Rule, Part III, Statute 7 has the agenda used for Council meetings. This is the same meeting agenda as expected of Conferences. Every Council has its own set of special considerations, and the agenda should be modified to accommodate its special programs and needs.

Q: Can Conference officers consist of the President Secretary, and Treasurer only, if no member accepts the Vice President appointment?
A: Conference officers (an elected President who appoints a Vice President(s), Secretary, and Treasurer) have no specific authority other than representation of the Conference and requirements to fulfill specific tasks. All decisions are made by the Active Members of the Conference as a whole. According to the bylaws there must be at least one Vice President, hence a member should step forward to serve as VP for a complete slate of officers. The Conference as well as the Council needs to know who will serve in the Presidential capacity should the elected President be unable to serve for any reason.

Q: How long do we have to keep our Conference records?

A: Generally speaking, a good rule of thumb is seven (7) years. On page 32 of the Manual, there is a complete list by type of record of the numbers of years you are required to maintain them. Official records are maintained by both the Secretary and the Treasurer. All officers should be aware of the retention schedule.

Q: Is it a breach of confidentiality to provide all Conference Members with a working list of current case numbers with full names of people we serve and the date the case was opened?

A: Confidentiality is highly emphasized within the Society. Reports may be used to reflect information about (our friends in need as long as that information is protected and not allowed to be seen by those who are not Vincentians. If you cannot ensure this, then don’t use that method. This concept holds true for Conference minutes, lists of active people served, treasurer reports, etc.

P: ¿Cuánto tiempo tenemos que conservar los registros de la Conferencia?

R: En términos generales, una buena regla general es siete (7) años. En la página 32 del Manual, hay una lista completa sobre el tipo de registro y los números de años que se requiere para mantenerlos. Q:  If a Conference currently included in the 501c3 group ruling enters into a collaborative effort with another nonprofit to operate a soup kitchen, is there any impact to exclude them from the group ruling?  Also, if that effort is exclusively a Conference effort, is there any impact on the council as part of the group ruling?

A: The answer to both questions is “no.”  If the Conference is using the Council’s EIN, the Conference should seek permission from the Council before establishing or joining a collaborative. The only real impact on the Council would be if they submit a consolidated 990 to IRS which includes all the Conferences.  If so, just be sure to report to the Council everything that is appropriate.  The Conference should not join into a collaborative with a for-profit organization.

 Q: Is it appropriate and ethical to donate a significant amount of money to a local Conference directing where that donation should go? e.g. a mortgage payment, a used car, tuition, etc. and then write that off your taxes as a charitable donation to SVDP?

 A: It is appropriate for Conferences to accept restricted donations that are identified for general things like food, rent, utilities, etc.  It is also permissible to accept donations to help a specific individual if the individual/family was approved for help by the Conference and if the donation was based on a request from the Conference to help that individual/family. It is legal to claim the donation to SVdP as a charitable write off.

It is NOT proper for a Conference to accept an unsolicited donation from a donor who wants the funds to go specifically to an individual/family for a purpose they designate.

 P: Si una Conferencia actualmente es incluida en el decreto del grupo 501c3; y esa Conferencia entra en un acuerdo de colaboración con otra organización sin fines de lucro para operar un comedor de beneficencia, ¿hay algún impacto para excluirlos del decreto del grupo?  Además, si ese acuerdo es exclusivamente un esfuerzo de la Conferencia, ¿hay algún impacto en el Consejo como parte de la decisión del grupo?

R: La respuesta a ambas preguntas es “no”.  Si la Conferencia está utilizando el EIN del Consejo, la Conferencia debe solicitar permiso al Consejo antes de establecer o unirse en una colaboración. El único impacto real en el Consejo sería si presentaran un 990 consolidado al IRS que incluya todas las Conferencias.  Si es así, asegúrese de informar al Consejo de todo lo que sea conveniente.  La Conferencia no debe unirse a una colaboración con otra organización con fines de lucro.

 R: Es correcto que las Conferenci as acepten donaciones restringidas que se identifiquen para cosas generales como alimentos, alquiler, servicios públicos, etc.  También está permitido aceptar donaciones para ayudar a una persona específica si la persona/familia fue aprobada para recibir ayuda por la Conferencia y si la donación se basó en una solicitud de la Conferencia para ayudar a esa persona/familia.  NO es correcto que una Conferencia acepte una donación no solicitada de un donante que quiere que los fondos vayan específicamente a un individuo/familia para un propósito que ellos designen.

Q:  Does the newly elected Conference President need to be inducted into office by the Council President to make it official?

A:  There is no formal requirement for the Council President to induct a newly elected Conference President.  There are liturgies/ceremonies that are available for newly elected Presidents that can be found in the book “Vincentian Celebrations” available through the National Office.

 Q:  Our District President resigned recently.  Instead of electing a new President, three Conference Presidents agreed to take part of the responsibilities.  So far it is working well.  Are we in compliance with the Rule or do we have to have an election?

A:  Within the structure of the Society, each District Council must have one, formal President and a full slate of officers.  Each of the Conference Presidents who accepted the specific roles you identified are effectively Vice-Presidents or Committee Chairs in their roles.  Only one person may be District Council President and fulfill those responsibilities.  An election will be necessary.

P: ¿Es necesario que el Presidente de la Conferencia recién electo sea investido por el Presidente del Consejo para hacerlo oficial?

R: No existe un requisito formal para que el Presidente del Consejo incorpore a un Presidente de Conferencia recién electo.  Hay Liturgias/Ceremonias que están disponibles para los Presidentes recién electos que se pueden encontrar en el libro “Celebraciones Vicentinas” disponible a través de la Oficina Nacional.

 P: Nuestro Presidente de Distrito renunció recientemente.  En lugar de elegir un nuevo Presidente, tres Presidentes de Conferencia acordaron asumir parte de las responsabilidades.  Hasta ahora está funcionando bien.  ¿Estamos cumpliendo con la Regla o debemos tener una elección?

R: Dentro de la estructura de la Sociedad, cada Consejo de Distrito debe tener un Presidente formal, y una lista completa de funcionarios.  Cada uno de los Presidentes de Conferencia que aceptaron las funciones específicas que usted identificó son efectivamente Vicepresidentes o Presidentes de Comités en sus funciones.  Solo una persona puede ser Presidente del Consejo de Distrito y cumplir con esas responsabilidades.  Será necesaria una nueva elección.

Correction to last week’s Q&A, use of member home address:  We have always discouraged the sharing of personal information of our members.  We do not share them with those we serve, and we should not share them with donors unless our official address is that of the President of the Council or Conference.

Q: I am member of a Conference and I have heard that 5th Sunday 2nd collection of the church should be for St. Vincent de Paul. However, it became apparent that our church is not following that. I would appreciate it if you could send me in writing when and how it was voted in by the USCCB.

A: The 5th Sunday collection is considered traditional, but it is not a formal collection throughout the Church. Any collection held on behalf of the Society is at the option of the pastor. You will find many instances throughout the country where there is NO 5th Sunday collection for the Society.

  Q:  Our Council has not been successful in identifying candidates for an election this September for various reasons. My second three-year term is ending but I am available to serve an additional year as president.  Is this allowed?

 A:  There is no extension of terms.  This is defined in the Nationally Approved Bylaws.  You will have to be out of office for three years before you are eligible to run again.

P: Soy miembro de una Conferencia y he oído que la colecta del 5º Domingo y la 2ª de la iglesia debería ser para San Vicente de Paúl. Sin embargo, se hizo evidente que nuestra iglesia no está siguiendo eso. Le agradecería que me enviara por escrito cuándo y cómo fue votado por la Conferencia de Obispos Católicos de los Estados Unidos (USCCB, por sus siglas en inglés).

R: La colecta del 5º domingo se considera tradicional, pero no es una colecta formal en toda la Iglesia. Cualquier colecta que se lleve a cabo en nombre de la Sociedad es a opción del párroco. Encontrará muchos casos en todo el país donde NO hay colecta del 5º Domingo para la Sociedad.

 P: Nuestro Consejo, por varias razones, no ha tenido éxito en la identificación de candidatos para las elecciones de septiembre. Mi segundo mandato de tres años está terminando, pero estoy disponible para servir un año más como Presidente.  ¿Es esto permitido?

Q: We have always promoted the idea that the funds our Conference receives go to help the poor. How can we spend funds on any other purposes?

A: Conference funds may be used for all legitimate expenses of the Society. Generally, this is a very small percentage of the overall funds. It is appropriate for Conferences to spend funds on resources needed to build our ministry by purchasing supplies/services/travel for training or forming our members spiritually or in service. In building up our members, we are building their ability to serve those in need. It is also appropriate to spend funds on resources such as brochures or pamphlets that will assist those we serve.

 Q: Is it ever appropriate (or legal?) for a Vincentian to use his/her home address instead of the Conference’s legal address? For instance, receiving checks made payable to “Society of St. Vincent de Paul,” but using a Vincentian’s home address instead of the Conference’s legal address.

A: As long as the check is clearly made payable to the SVdP Conference and no one else, the home mailing address is allowed.

P: Siempre hemos promovido la idea de que los fondos que recibe nuestra Conferencia se destinan a servir a los pobres. ¿Cómo podemos utilizar los fondos para otros fines?

R: Los fondos de la Conferencia pueden ser utilizados para todos los gastos legítimos de la Sociedad. Por lo general, se trata de un porcentaje muy pequeño de los fondos totales. Q: Our Conference has been struggling for a long time to get a regular Spiritual Advisor. One of our long-time members volunteered, but he is the husband of one of our Active members and is non-Catholic. He is a very spiritual person. Is this okay?

A: No. Article 6.5 of Part I of the Rule states: The Catholic beliefs and ethos of the Society of St. Vincent de Paul must be preserved. The President, Vice President and Spiritual Advisor should, therefore, be Roman Catholic.

Q: Part I of the Rule indicates that non-Catholics can serve as officers (Secretary or Treasurer) and in Part III, it says that only Catholics can be officers. Is there a conflict in the Rule?

A: There is no conflict. Part I is the International Rule. Part III of the Rule is associated with the Society in the United States. This provision in the Rule Part I is there to allow the Society to function in countries where there are not many Christians and interdenominational cooperation is common. We consulted with the Episcopal Conference, as required by the Rule, and through our Episcopal Advisor, they made it clear that they did not favor active members or officers being non-Catholics.

 P: Nuestra Conferencia ha estado luchando durante mucho tiempo para conseguir un Consejero Espiritual.  Uno de nuestros miembros que está con nosotros desde hace mucho tiempo, no es católico, pero se ofreció como voluntario, es esposo de uno de nuestros miembros activos.  Él es una persona muy espiritual.  ¿Es esto correcto?
