Q:  Are all three levels of membership eligible for the Top Hat Award? Is the ‘spirit’ of the Top Hat Award to nominate someone who is an Active or Associate Member, but not necessarily someone who is a Contributing Member?

A: The Top Hat Award is a local award given by the local SVdP Council, who decides the requirements and eligibility for the award. The National Council has no guidelines for this award and does not determine which membership level is eligible to receive it. This is a decision solely for each local Council. Also, since the Rule was last amended in 2018, it no longer recognizes Contributing Members, but only Active and Associate Members.”

Q: Can our Council Thrift Store consider hiring individuals with criminal records? There are some obvious instances like a pedophile, or sexual abuse convictions that we perhaps should prohibit, but how do we give an individual a second chance for less offensive convictions? What is the Society’s position on hiring practices for these individuals? 

A:  Before creating a hiring policy or creating a Safeguarding policy, check with a local employment attorney. There are locations where you are not allowed to discriminate based on criminal record (even pedophiles), unless it is a job-related offense. There have been cases of high damages won in some cases when there was never a chance of the employees having contact with children. Having a written policy could actually be used as evidence of intent to discriminate. These are decisions made by local SVdP Councils and Conferences under our principle of subsidiarity. Many of our Councils offer services for returning citizens, including employment training and placement services, so we should consider our own hiring practices as a matter of example. The Safeguarding Task Force has produced a Policy Assistance paper to help Councils (and as needed, Conferences) develop their own Safeguarding policy, a recognized priority of the National Council. Conference and Council Leadership Training Curriculum

From 2019 to 2022, the Leadership Task Force (LTF) developed webinars to help current and potential leaders in the Society of St. Vincent de Paul. These webinars are now available as a “Leadership Curriculum” for Conference and Council presidents in both live and recorded form. By following this curriculum in the suggested order, a president can obtain the knowledge and skills to become a more effective Servant Leader.

Videos of the webinars can also be accessed on our National website, along with the PowerPoint presentations with notes, and suggested handouts. Besides recommending to members that they attend the webinars when offered by National, Council Formators can utilize the LTF materials on the web to provide training/formation to their leaders, both novices and veterans. They can facilitate discussion of one of the video webinars or they can use the PowerPoints and the notes to present themselves, perhaps adding a few local touches to the presentation.

Q: What is your recommendation on having our current store and new store establishing separate EIN’s rather than under the Council umbrella. If it is recommended that they set up their own, would we have one EIN for stores or would we have one for each store?

A: This is a local decision. However, if you opt to separately incorporate a store under its own EIN (or a group of stores under a single EIN), care must be given to the formation of the new entity and the bylaws to ensure that ownership and control are still in the hands of the Society entity that created them. The Special Works Bylaw was created specifically with this in mind. You will also need to establish separate tax-exempt status, and file separate Form 990s annually, for each incorporated entity.

Q: Is a Conference permitted to receive a gift of stock or mutual funds from a donor? If so, how so and are they able to draw off dividends?

A: At various times, Conferences and Councils have accepted stock and/or mutual funds as gifts.

With the right procedures in place, Councils or Conferences can receive gifts of stock. Receiving such donations requires a brokerage account, which is something most Conferences don’t have. Conferences need to consult their next highest Council for advice. This is especially necessary if the Conference does not have its own EIN, in which case such funds would be under the Council’s control. Typically, stocks are sold, as they are often donated at their highest value. We are servants of the poor, not investors. In the case of very large gifts, we recommend money market accounts to preserve funds for future services. The National Council has a document on the use of funds called Hoarding – What Does It Mean, that provides good insight into the use of large donations.

Q: Does the Conference president have the authority to override a negative vote when there is a request to suspend the normal guidelines for providing assistance to a neighbor in need? 

A: All of the guidelines are determined and established by the Conference as a whole. The only party who can go against those guidelines is the Conference as a whole, either changing the guidelines or establishing the case as an exception. The president may contradict a decision of the Conference if that decision violates the Rule of the Society. The treasurer may contradict a decision of the Conference if it calls for spending more money than is available.

Q: After reviewing the bylaws template for District Councils without a board (Document #8), a question arose. As I understand it, the voting members of the Council must also be Conference presidents. Does that also mean that the officers appointed by the District Council president must come from the Conference presidents? If not, what voting rights do these individuals have? Can the District Council Board grant voting privileges to an officer who is not a Conference president.

A: When you have a District Council that is not incorporated (without a Board of Directors), you must follow the standard structure of voting for a District Council. The only voting members are the District president and the Conference presidents. Period. The VP(s), secretary(ies), and treasurer(s) can only vote if they are also Conference presidents. Based on the standard structure of an SVdP District Council, a District Council (not incorporated) cannot appoint additional voting members.

Please keep in mind that incorporated District Councils would use Bylaws Documents #3 or #6, which allow for a Board of Directors and appointment of additional voting members.

Q: If our mission is to be holy and lead others to Christ-like holiness does it make sense to have a Jewish person as a lead role?

A: An Associate Member is someone who helps us with our works of service. He/she may or may not be Catholic. According to the Rule, they can indeed be members on committees; but cannot vote as stated in the standard bylaws. They can also be the chair/head of committees, but not officers at any level.

Q: A Conference in our diocese has been given by the Bishop to the Latin Priests. He does not want a Conference attached to the parish but is okay with a free-standing Conference that serves the poor in his area. Is there anything Conference members need to do to inform National that we are no longer a parish-based Conference?

A: There are no National Council records that have to be changed – only the way the Conference operates and solicit funds and members. The Diocesan Council and District Council must be aware of this arrangement.

Q:  How involved can a pastor be with the Society of St. Vincent de Paul? I believe I read somewhere that SVdP is a separate entity from other organizations in the Church, and that the pastor cannot tell us what to do with our donations (monetary). Are they able to tell us, for example, when, or if, we can or cannot collect food for the poor? When, or if, we can or cannot have more than two food drives a year, etc.?

A:  You will find in both the Rule (Part III, Statute 15) and the Manual (pages 50), that ordained ministers (deacons and priests) normally hold the role of Spiritual Advisor of a Conference or Council. They are asked to give Conference members spiritual guidance related to their own personal growth, as well as their ministry; and they can participate in any Conference discussions. They may also go on Home Visits if they choose. They are not the decision makers of the Conference. Ordained ministers may not vote or hold office or be a signor on Conference accounts.

SVdP is a lay organization in the parish at the invitation of the pastor. We must therefore maintain good relations with him and the parish staff. The pastor can control when and what types of parish collections are to be held, how often parish facilities can be used by outside groups including SVdP, and other decisions involving parish operations and policies. They do not control SVdP finances and are not to be signors on Society bank accounts. Ask your District or Diocesan Council President to meet with your pastor and try to resolve any issues or concerns from Conference.

Q: It came up at our last meeting whether or not Conferences can apply for grants? Not sure if that is allowed since all our funds are donations.

A: All Conferences are eligible to apply for grants. However, if a Conference is using a Council’s EIN, it must have the permission of the Council to apply for the grant; technically, the owner of the EIN is the responsible party for the grant and must ensure the terms of the grant are honored.  The National Council offers grants to Conferences such as the Friends of the Poor® grant.

Q: My Conference is now on Facebook and has a Twitter account, in addition to our website. Is it okay for us to use the Society’s logo for our avatar in these mediums and for all official business?

A: All Conferences and Councils in good standing with the National Council can use the Society’s trademarks, which include logos, for official SVdP work.

Q: I have a couple of new members, actually, husbands of active members, that want to help when needed. Are they required to attend Ozanam Orientation within one year of joining?

A: All Active Members must attend an Ozanam Orientation within a year of joining the Conference. Associate members, which would be the membership category of the spouses you are referencing, are not required to attend. The Ozanam Orientation and Serving in Hope are the primary training programs for Vincentians. Both emphasize the importance of spirituality. However, this is what we say in our training. We are not strictly a spiritual organization, we are not strictly a social organization, and we are not strictly a service organization. There must be a balance between the three objectives of the Society.

In August of 1833, Leon Le Prevost, a member of the first Conference who later went on to establish the Religious Order of St. Vincent de Paul, wrote: “In this moment there is a great movement of charity and of faith…” The same could be said of our time and our place in this world. Although we are often distracted by negative forces, influences and movements, we must never lose sight of the hearts of our non-Vincentian brothers and sisters who like us long to help others. We witness that concern and compassion flow out of the actions of individuals, families, corporations, faith-based groups and civic organizations as they respond to natural disasters and other large-scale tragedies.

From the very early days of the Society, our founders understood the need to work collaboratively with the government and other organizations in order to better assist the poor and suffering. In December of 1833, the first Conference accepted the role of “Commissioners of Charity” for the administrators of the La Bienfaisance neighborhood. While our present-day Councils often enter into collaborative agreements and relationships, our local Conferences tend to function primarily in cooperation with other Conferences and Councils, seldom reaching out to other groups in their local area.

If Conferences are isolated and do not interact and cooperate with other local faith-based groups and charitable organizations, we are overlooking resources including potential volunteers who can assist us in providing assistance to our neighbors in need. By joining forces we not only increase our ability to help others but we also engage the community and provide others with the opportunity to be actively involved in helping those in need. Additionally, our outreach efforts help spread knowledge about the Society and our mission of charity and love.

On the Conference level, most collaborative relationships do not require a formal contract but more of a mutual understanding based on agreement in protocols and policies. Identifying groups in your area should be the starting point followed by outreach and relationship-building. Such relationships should start by sharing with the group’s leaders or members our history and mission, as well as letting them know how we currently serve those in need in our community.

The process must include a two-way conversation that provides us with an understanding of who they are and how they currently serve the community. Once that relationship is built, we can begin a conversation on how we can work together to benefit the needy, always keeping in mind that we can only function within the Rule of the Society. Just as we honor who they are and their procedures and guidelines, they must honor ours. For example, potential collaborative partners need to understand early on we cannot share funds with them or any project that our members are not involved in through person-to-person contact with the poor.

When Frederic Ozanam helped to establish the Society, he envisioned a network of charity that would encompass the world. Vincentians are only part of that network. Our vocation calls us to reach out and serve beside other people of goodwill to help relieve poverty and injustice. By reaching out to them we can enhance the work of our Conferences and provide opportunities for them to join us in service to the least among us.

Such collaboration can make a huge difference. Ask yourself, “How can our Conference build relationships with other groups and churches?” With the help of others, we can do more and experience the love of Christ in those whom we serve and in those whom we serve beside.

Q: We are attempting to re-write our policy and procedures and the topic of store discounts came up. Checking with other SVdP stores and other non-profit thrift stores, we learned that most give their employees and volunteers (both non-Vincentian and Vincentian) discounts. Should Vincentian discounts be allowed? Can you give us further insight on this? 

A: First, it is a local decision regarding when any store discounts are allowed. Granting a discount to employees and volunteers working at a store is an acceptable practice. The percentage of the discount should never be extravagant since that would make us self-serving. Whether the discount should be offered to other Vincentians who do not work at the store is a decision of the Conference or Council that owns the store. Keep in mind that Vincentians do not receive compensation for their Conference work.

Q: We take a secret collection at each of our Conference meetings. I was under the impression that we can’t use the Conference general fund for anything other than helping our neighbors in need. However, it is my understanding that we could vote on how to use our secret collection funds. We took a vote to help fund a homeless coalition with the rental fees for a storage unit that holds their donated items for the homeless. We agreed to cover the storage rent for the next 6 months with our secret collection funds. Two-part question, did we break the rules. We are obligated to pay for 3 more months out of the 6 we voted to pay; can our Conference still pay the remaining balance?

A: Conference Members may vote to use their secret collection for purposes other than contributing to the Conference. They may choose to collect funds and contribute the secret collection for a particular purpose; however, when contributing the secret collection to another organization, the contribution must not be identified as coming from SVdP. It would be a contribution simply collected to support a particular effort. A Conference should never agree to support another organization unless it is a Vincentian entity. Clarify that the donation would be from individuals, not the Society, to fund outside organizations needs to be defined before the collection takes place.

The Rule is not specific about the secret collection. The secret collection goes back to the beginnings of the Society. In the beginning, funding for the Conferences came strictly from the members themselves. There was no parish funding, no special collections. The secret collection gave an opportunity for each member to contribute what they could to the works of the Conference without anyone knowing who gave how much. On page 87 of the “Apostle in a Top Hat,” it indicates the first Conference used a top hat for the secret collection. Today, the secret collection is more of a token.

The bottom line is that the use of those funds is the decision of the Conference as a whole. How those funds will be used should be decided before the collection is taken. It’s a Conference decision and once the decision is made, it must be honored by all members.

P: Queremos modificar nuestra política y procedimientos y encontramos el tema de los descuentos en tiendas. Consultando con otras tiendas SVDP y otras tiendas de segunda mano sin fines de lucro, aprendimos que la mayoría ofrece descuentos a sus empleados y voluntarios (ambos vicentinos y no vicentinos). ¿Deberían permitirse los descuentos vicentinos? ¿Puedes darnos más información sobre esto? 

R: Primero, es una decisión local con respecto a cuándo se permiten los descuentos en tiendas. Otorgar un descuento a los empleados y voluntarios que trabajan en una tienda es una práctica aceptable. El porcentaje del descuento nunca debe ser extravagante ya que eso nos haría egoístas. Si se debe ofrecer el descuento a otros vicentinos que no trabajan en la tienda, es una decisión de la Conferencia o Consejo propietario de la tienda. Tenga en cuenta que los vicentinos no reciben compensación por su trabajo en la Conferencia.

P: Realizamos una recaudación secreta en cada una de nuestras reuniones de la Conferencia. Q: Where can I find help to fill out my annual report?

A: Information on how to fill out your annual report can be found on the Annual Report Forms page of member part of the publicly accessible website. The Help Files section contains video links and a questions and answers document to assist you in filling out your annual reports.

You can also view tutorial videos on how to access annual reports and filling out the reports on the SVdPUSA Vimeo channel. These tutorials and more can be found by logging into the Members Portal and clicking Need Help? in the left side navigation.

Q: I have a Conference that has stocks that show a lesser value on their September 2022 statement (stock market correction) than on the September 2021 statement. How do I show that on the Conference report? Under 12. Other? As unrealized capital loss?

A: The annual report is based on cash receipts and stock information should only be included if they are purchased. Stocks and Bonds have a cash value when they are purchased, and the value should be shown as if it was a savings account or CD. Only cash assets should be included on the report. There is no place for non-monetary items and the value of donated stocks, furniture, building, etc. should not be included in Conference annual reports because they are not cash items. If the purchased stocks or the donated items are sold, the cash received becomes a gain or loss and is reported as other income on the report. Please keep in mind that the SVdP annual report is in no way a mirror of IRS filings.

It is not common for Conferences to purchase stocks. Conference funds are meant for assisting neighbors in need in the short term, not for investment purposes. If there as a gift of stocks, it should be part of a Conference’s plan to spend them in a reasonable time period.

P: Si una Conferencia tiene acciones que muestran un valor en su estado de cuenta de septiembre de 2022 que es menos de septiembre de 2021 por causa de un corrección del mercado de valores, ¿cómo informar eso? ¿Bajo 12, Otro, o como pérdida de capital no realizada?

R: El informe anual se basa en los recibos de efectivo y la información sobre acciones sólo debe incluirse si se compran. Las acciones y los bonos tienen un valor en efectivo cuando se compran, y el valor debe mostrarse como si fuera una cuenta de ahorros o un CD. Solo los activos en efectivo deben incluirse en el informe. No hay lugar para artículos no monetarios y el valor de las acciones donadas, muebles, edificios, etc. no deben incluirse en los informes anuales de la Conferencia porque no son artículos en efectivo. Si las acciones compradas o los artículos donados se venden, el efectivo recibido se convierte en una ganancia o pérdida y se informa como otros ingresos en el informe.
